1. General Provisions

 

1. Department of Development of Electronic Industry of the Ministry of Defense and Aerospace Industry of the Republic of Kazakhstan
(hereinafter referred to as the Department) is a structural subdivision of the central apparatus of the Ministry of Defense and Aerospace Industry of the Republic of Kazakhstan (hereinafter - the Ministry).
2. The Department in its activities is guided by the Constitution of the Republic of Kazakhstan, Constitutional laws, laws, acts of the President and the Government of the Republic of Kazakhstan, other regulatory legal acts, and this Regulation.
3. The structure and staffing of the Department shall be approved by an order of the Executive Secretary in the manner established by the legislation of the Republic of Kazakhstan.
4. Structure of the Department:
1) Office of Information and Communication Technologies;
2) Management of the electronic industry.


2. The main tasks, functions, rights and duties of the Department

5. Objective: formation and maintenance of state policy in the field of electronic industry.
Functions:
1) coordination and methodological support for the development of the electronic industry;
2) implementation of strategic, regulatory functions within the competence;

3) development, coordination within the limits of its competence of drafts of normative legal acts, as well as generalization of law enforcement practice on the electronic industry;
4) implementation of the general management of activities for the development of the electronic industry;
5) development of proposals for the improvement of the regulatory legal framework for the development of the electronic industry;
6) participation in the development of proposals for state support of investment projects in the electronic industry;
7) analysis and monitoring of the electronic industry;
8) coordination of activities of subordinate organizations in the field of electronic industry;
9) study of international normative acts, standards, as well as scientific works for the purpose of analyzing, summarizing and systematizing information in the field of the development of the electronic industry;
10) implementation of bilateral cooperation (jointly with the Department of International and Military-Technical Cooperation) with authorized bodies and foreign organizations on the electronic industry;
11) ensuring the protection of state secrets and official information of limited distribution in the Ministry;
6. Objective: to create conditions for the acquisition and use by state and quasi-state bodies of electronic products and software products of domestic production, as well as to build production links between domestic enterprises and organizations in order to effectively use available resources.
Functions:
1) submission of proposals to regulatory legal acts to stimulate activities in the field of development and production of electronics;
2) preparation of proposals to protect the economic interests of the domestic electronics industry in the external and internal market;
3) regulation of issues related to the use of domestic electronics by government agencies;
4) preparation of proposals for promising research and development work in the development of production of electronic products;
5) interaction with foreign policy departments and overseas institutions of the Republic of Kazakhstan, as well as other state bodies, organizations of the Republic of Kazakhstan on the electronic industry;
6) coordination of the rules for the formation and maintenance of the register of trusted products of the electronic industry and software, and also the criteria for including products of the electronic industry and software in the register of trusted products of the electronic industry and software;
7) coordination of the formation and maintenance of the register of trusted products of the electronic industry and software;
8) other functions within the competence of the Department.
7. Rights and Duties:
Rights:
1) submit for consideration to the leadership of the Ministry proposals on the issues falling within the scope of the duties of the Department;
2) on behalf of the management, represent the Ministry in the state bodies of the Republic of Kazakhstan, international organizations and foreign states within its competence;
3) on behalf of the leadership of the Ministry, hold meetings and negotiations with representatives of electronic industry producers of the Republic of Kazakhstan, foreign states and international organizations;
4) to request and receive from the structural subdivisions of the Ministry and organizations the materials necessary for the performance of their functions;
5) to request and receive reports and protocols from the heads and employees of the Ministry's structural units with conclusions and recommendations on the results of meetings and negotiations with domestic and foreign delegations, as well as on business trips;
6) to exercise, within the competence of the Ministry, other rights for the implementation of tasks and functions assigned to the Department.
Duties:
1) perform tasks and functions assigned to the Department in a timely and high-quality manner;
2) not to violate the norms of the Regulations of the Ministry and the Rules for Documentation and Document Management in the Ministry;
3) present the necessary materials and references within the limits of their competence and within the framework of the legislation in case of an official request for this by the structural units of the Ministry and state bodies;
4) ensuring the preservation of state property;
5) ensuring that the Department's staff comply with the ethics of administrative civil servants;
6) to consider appeals, applications and complaints of individuals and legal entities on issues within the competence of the Department, in accordance with the procedure established by the legislation of the Republic of Kazakhstan;
7) to develop and improve normative legal acts in the areas under supervision within the competence of the Department.

8) carry out, within the competence of the Ministry, other duties for the implementation of tasks and functions assigned to the Department.


3. Organization of the activities of the Department

8. The Department has the powers necessary to realize its main tasks and functions, in accordance with legislative acts, acts of the President of the Republic of Kazakhstan, and other normative legal acts of the Republic of Kazakhstan.
9. The department is headed by a director who is appointed and dismissed in accordance with the procedure established by the legislation of the Republic of Kazakhstan.
10. The Director of the Department has a deputy in accordance with the approved structure of the Ministry.
11. The Director of the Department carries out general management of the department's activities and bears personal responsibility for performing the tasks assigned to the Department and carrying out its functions.
12. The Director of the Department submits proposals on the structure and staffing of the Department to the management of the state body.
13. To this end, the Director of the Department:
1) defines the duties and powers of his deputy (deputies), if any;
2) defines the duties and authorities of the heads of the structural units that make up the Department;
3) exercise other powers in accordance with the laws and acts of the President of the Republic of Kazakhstan.
14. Deputy Director of the Department of the State Body:
1) coordinates the activities of the Department within its authority;
2) during the absence of the Director of the Department, he exercises overall direction of the activities of the Department and bears personal responsibility for the performance of tasks assigned to the Department and the exercise of its functions;
3) exercise other functions assigned by the Director of the Department.
15. Documents sent on behalf of the Department to other structural units on issues within the competence of the Department are signed by the Director of the Department, and in case of absence, by the Deputy Director.
